LiveBy, Inc. ("LiveBy," "we," "us," or "our") respects your privacy. This Privacy Policy describes how we collect, use, disclose, and protect information through our web application, website, and related services (collectively, the "Services"). It applies to users in the United States and Canada. Under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), we act as a service provider and do not sell or share personal information.

1. Introduction

Scope: This Policy covers personal information collected online via the Services, including during email communications and integrations. It does not apply to offline practices or third-party sites.
Compliance: We comply with CCPA/CPRA (including 2025 updates on automated decision-making technologies (ADMT), risk assessments, and cybersecurity audits), and for Canadian users, PIPEDA (requiring meaningful consent and safeguards). We conduct annual cybersecurity audits as required under CPRA starting in 2026 if applicable thresholds are met.

2. Information Collected

Personal Information: We collect contact details such as first and last name, email address, phone number, professional affiliations including brokerage, MLS affiliations, MLS #, website, and social media links. For subscribers/leads (at your request), we collect first/last name and email. This may include images, market insights, or other content you submit as part of User Content (as defined in our Terms of Service).
Usage Data: Historical email campaign metrics (e.g., sends, clicks, opens); device information (e.g., IP address, browser type) for analytics.
MLS/Aggregate Data: Aggregate geo-specific MLS reports (listings, prices, pictures) from licensed feeds; no individual transaction histories or sensitive data (e.g., health, financial details beyond basics).
Sources: Directly from you during registration, use, or submission of User Content; supplemented from public or MLS sources; automatically via cookies or logs.
Partner Data: If you are a Sponsored User, we may receive your contact and professional information from your Partner.

3. How We Use Information

Services: To provide and personalize the Services, including generating reports, sending scheduled emails, AI summarization of report data (limited ADMT; no automated decisions affecting legal rights or profiling), facilitating integrations, and additional functionality such as integrating User Content into agent insights features with attribution to you.
Improvements: Analyze anonymized aggregates and historical metrics to optimize performance and features. We may productize information derived from User Content, such as creating new tools, datasets, or derived works for general use within the Services.
Marketing: Send transactional emails (e.g., market updates) based on your requests; distribute User Content (with attribution) through agent insights or affiliated features; no promotional ads.
Legal: For compliance, audits, dispute resolution, and security (e.g., breach prevention). Even after account termination, we may use anonymized, aggregated forms of data (without identifying you or individuals) for AI-generated summaries, overviews of geo-specific areas, or service enhancements.
All uses require your consents where applicable (e.g., from subscribers for distribution or productization).
Partner Integrations: We share data with Partners to enable Sponsored Access and display LiveBy content in their platforms (with attribution). All use is governed by these Terms and our agreement with the Partner.

4. Sharing & Disclosure

Providers: We share with service providers like Stripe for payments (governed by data processing agreements and their privacy policies); hosting and analytics vendors bound by contracts restricting use to service delivery.
Third Parties: We do not sell, share, or rent personal information under CCPA definitions. Sharing is limited to operational needs, but may include distribution of User Content (with attribution) through agent insights or productized features within our ecosystem. For productization involving third parties (e.g., affiliates), we ensure contracts limit use and require anonymization where possible. For Canadian data, transfers comply with PIPEDA safeguards.
Partners: We share data with Partners under contract to provide Sponsored Access. Partners are bound by data protection obligations. No sale of data occurs.
Legal: We may disclose information in response to legal requests (e.g., subpoenas), to protect rights, or in mergers/acquisitions. In breaches, we follow our response process, notifying affected parties as required (e.g., within timelines under applicable laws).

5. User Rights & Controls

Access/Correction/Deletion: Submit requests via privacy@liveby.com or our form. We respond within CCPA (45 days, extendable) or PIPEDA (30 days) timelines. You may access, correct, or delete your data, including User Content, subject to exceptions (e.g., for security, debugging, or legal obligations). Deletion requests will remove identifiable data, but anonymized aggregates may persist for permitted post-termination uses (e.g., AI summaries).
Opt-Out: Unsubscribe from emails via links in messages. For distribution or productization of your User Content, you may opt-out by contacting us, which may limit certain features. We do not "sell" or "share" data, so no "Do Not Sell/Share" opt-out is needed. We do not honor Do Not Track (DNT) signals.
CA Residents: CCPA rights include knowing collected data, deletion, correction, opt-out of sales/sharing (none occur), and non-discrimination.
Canadian Residents: PIPEDA rights include withdrawing consent (which may limit Services or post-term uses), accessing data, and challenging accuracy.
ADMT/Risk Assessments: Our AI is limited to summarization; you may request details on its use, including for productized features or geo-overviews, per 2025 CPRA updates. We perform risk assessments for ADMT as required.
Sponsored Users: You have the same rights to access/correct/delete data, but deletion may not remove data already shared with your Partner. Contact your Partner for their data practices.

6. Security & Retention

Measures: We use industry-standard safeguards, including encryption, access controls, and regular audits to protect data. Our breach response process includes investigation, mitigation, and notifications to affected parties and authorities as required.
Audits: We conduct annual cybersecurity audits per CPRA requirements starting in 2026 if we meet processing thresholds.
Retention: We retain data as necessary for Services (e.g., historical metrics indefinitely for disputes or improvements). Upon termination or deletion requests, we cease using identifiable data but may retain anonymized, aggregated forms for AI summaries, geo-specific overviews, or productized enhancements. We delete data upon valid requests unless retention is required for legal, security, or operational reasons.
Post-Termination Data Access: Upon cancellation, you lose all access to your account and data at the end of your billing cycle. Export your data before canceling — no retrieval is available afterward. Anonymized aggregates may be retained for AI summaries or geo-insights as disclosed.

7. Cookies & Tracking

Use: We use cookies for session management, preferences, and analytics (e.g., via Google Analytics—see their policy at https://policies.google.com/privacy).
Controls: You can manage cookies via browser settings; opting out may limit functionality. We do not engage in cross-site tracking.

8. Children & Changes

COPPA: The Services are for real estate professionals only and not directed at children under 13. We do not knowingly collect data from minors.
Updates: We may update this Policy and will post changes with notice via email or the Services. Continued use constitutes acceptance.
